1. Remain Silent

It’s often best to give the officer the minimum amount of information required, such as your name and address. Beyond that, keep your lips sealed. Anything else you say may be used against you later, even if it seems harmless at the moment.

2. Politely Say No to Field Sobriety Tests

Field sobriety tests aren’t guaranteed to be a good determinant of intoxication, given that even a sober person can fail them. Even if you feel pressure to conform to the officer’s demands, you have the right to refuse these tests.

3. Keep Your Excuses to Yourself

When you’re pulled over, you may feel the urge to explain yourself. But remember tip #1 and stay silent. Your argument may get you into deeper trouble by admitting wrongdoing and confirming the officer’s suspicions. 

4. You Can Refuse a Breathalyzer in Texas

In all 50 states, refusing a breath test can result in additional consequences. But in Texas, the only consequence is a suspended license. While this may be inconvenient, you can avoid incriminating yourself and get your license back later. 

5. No Warrant? No Blood

Additionally, you can refuse a blood test until officers have a warrant. If their warrant contains any flaws, you may be able to get your case dismissed.
